RestaurNote Terms of Service

Terms of Service

Last Updated: August 31, 2018

Usage of RestaurNote constitutes agreement with these Terms of Service, as well as our Privacy Policy.

RestaurNote reserves the right to update these Terms of Service and its Privacy Policy at any time, with or without notice. Continued use of the service constitutes acceptance of these policies and terms.

The RestaurNote service is designed for individual users to take notes at a Location (accessible by the general public), such as restaurants, bars, and entertainment venues. These locations are tagged with public geo-location/GPS coordinates (latitude/longitude). Users may choose to be reminded of these notes whenever they visit that location at a later time, or they may search through previous notes that they created or that others have created and publicly shared.

Your account settings include a "Display Name", which is used to identify you as the author of any note that you create and share publicly. Public notes are always displayed associated to the "Display Name" of the account which created them, current as of the time of display. While you are allowed to specify any common name or nickname that you wish for your "Display Name", you must not use offensive language (profanity, sexual or racial terminology, etc), or otherwise misrepresent your identity, to have the intent or effect of abuse, harassment, confusion, or deception of other users of the service. RestaurNote reserves the sole right to determine the appropriateness of any "Display Name" and to either modify it or delete the offending account.

All notes that you choose to create in RestaurNote can be made private-only (only visible to you) or shared publicly. Notes are limited to a certain number of characters. If your note is marked as private, it may contain any content you find useful. If your note is shared publicly, it must abide by certain additional guidelines.

Publicly shared notes must not contain any content that resembles personally-identifying information (persons' names, addresses, contact information, etc). Publicly shared notes must not contain any content that violates any applicable laws (copyrighted content, etc), for any respective legal jurisdiction. Publicly shared notes must not contain any content which is offensive or abusive directed at individuals or to any group of people. Criticisms of businesses in relation to their services provided to the public are allowed in publicly shared notes, as long as those comments are not directed at individuals or groups of people in a manner inconsistent with these Terms of Service.

Aside from the above exceptions, RestaurNote will never hide, obfuscate, or censor any publicly shared note, even if it is damaging to the reputation the business it's attached to. Businesses can not have notes removed for any reason other than those outlined in these Terms of Service.

Any note that violates any part of these Terms of Service or the RestaurNote Privacy Policy is subject to removal at the sole discretion of RestaurNote.

All notes created in RestaurNote are assigned to a "Location", which is typically a restaurant, bar, or other entertainment venue that is accessible to the general public. These locations are created in the RestaurNote system by users, including the visible label name, its approximate geo-location/GPS coordinates (latitude/longitude), and its approximate estimated size. All locations (including their geo-location/GPS coordinates and label names) are public and can be seen by anyone using the RestaurNote service.

If you are creating a location in RestaurNote, use the common public name to label that establishment. Do not create duplicate location entries. Any location found to be a duplicate, or inappropriately/inaccurately named, or deliberately or misleadingly with the wrong geo-location/GPS position, is subject to removal at the sole discretion of RestaurNote.

You must not create locations for private locations like residences or government restricted-access facilities; only create locations that are accessible to (and frequented by) the general public. Any location that is determined to be private, restricted by any governing authority, or otherwise inappropriate for public listing will be removed at the sole discretion of RestaurNote.

Any notes attached to a removed location will also be removed or merged to another location, at the sole discretion of RestaurNote.

You are permitted to use RestaurNote for free, personal use, without any limitations other than those listed in these Terms of Service. You must not use any form of automated access, collection, or aggregation of RestaurNote's data, or Google Maps' data, for any reason. Any account found to be violating these restrictions is subject to immediate removal at the sole discretion of RestaurNote.
